i've tried to reset both plugged and not. i see a half full static battery image in grey when plugged in and nothing at all when not plugged in - i know it's under warenty but am worried that i won't see my files again.

If the error is not a hard drive failure, you theoretically should be able to recover your data. It would effectively require either (a) fixing the unit (most likely by replacing the defective component) or (b) getting the iPod to at least mount on your computer so you can get the files off.
Practically speaking, it may be more difficult. Apple generally handles warranty repairs by simply swapping the iPod out for a new one. (The assumption they seem to make is that the music stored on the iPod is on your computer in iTunes, allowing you to sync a new iPod to that.) If you're planning to get a warranty repair, be prepared anything which is only on your iPod.
So your best bet is trying to figure out how to get the iPod to connect to a computer, either to iTunes or simply as an external drive. If you can do that, you have a chance of getting your files back. If you live near an Apple store, try visiting their in-house tech support (AKA the Genius Bar). Once the data are safe, you can get your iPod exchanged.

Yes - your files are stored on a small hard drive, not in RAM memory, which means that they are saved even during a power failure. Everything is there, be sure to ask for a new battery or take your unit to a qualified technician for servicing.
